Patent Deposit

Microorganisms became patentable subject matters in 1994 in this country. According to the Patent Law, "in applying for an invention patent involving any microorganisms or the utilization of any microorganisms, the applicant shall, no later than the filing date, deposit the microorganism at a domestic depository designated by the Patent Authority." FIRDI was designated by the Patent Authority as a domestic depository accordingly in 1994. To operate the patent depository service, FIRDI enacted a "Regulations for Deposit of Biological Materials for the Purposes of Patent Procedure" in 1995. The 1995 Regulations, currently not applicable , was implemented until 2002.

The current Regulation was enacted by the Patent Authority in 2002, and amended in 2003, to comply with the 2001 Patent Law, and the current Patent Law, respectively.

Import Permit Application Service

According to "Regulations Governing Management of Infectious Biological Materials and Collection of Specimens from Patients of Communicable Diseases" of 2006, "non-installation units may not apply for the export (import) of infectious biological materials." FIRDI, one of the installation units, now provides service for assisting depositors to apply import permits. Please refer to the attachments for service details and the content of contracts.
